Commissioner of Police Vs. Scott McPhee

Friday July 21st, 2023

... The court is well aware of the circumstances of gun crime in this jurisdiction and agrees with the Crown that the eight-month sentence is in fact unduly lenient. The court has also looked at ranges of sentences for like offences and has considered that this one is way out of line. The eight months is unduly lenient for the particular facts and circumstances in this case and this court considers that it is more appropriate that a sentence of two years be substituted therefor. In the result, the eight-month sentence which the magistrate imposed for these two offences is quashed. We each offence commencing from the date of his conviction. That is the decision of the court.
