The application for bail was made on 14th July, 2021, and the trial date is set for July 2023, so the period of delay for the trial is not unreasonable. It is not outside of the three-year period. We believe that if sometime next year the trial does not occur, the appellant has the right to make another application for bail on a different basis.
Based upon the application for bail, on the amount, we do not think it is unreasonable and we refuse the application for variation at this time.
