Kirk Stuart Vs. Commissioner of Police

The Court accepts that and we find that the proper order should have been, in our considered opinion, 3 years, which we find to be reasonable and we do not interfere with that. We set aside the fine and impose instead a sentence of 1 year, which is to run concurrently with the 3-year sentence. As a result, the appellant will serve only the 3 years that was imposed. The judgment is varied to that extent.
